A decision imposing an entry ban catches many people unprepared. Alongside the personal strain, a practical question arises at once: what needs to be done now and how much time is left? This article sets out the first steps and the most important deadlines.

The appeal deadline is central. It begins with service of the decision and determines whether the entry ban can be reviewed or becomes final. Anyone who knows the deadline and calculates it correctly gains the necessary room for action.

The deadline is still running, the appeal can be prepared carefully.

You have already taken the most important step and have the service date in view. Use the remaining time to read the decision carefully, examine the reasoning behind the entry ban and document your ties in Austria. An appeal is all the stronger the more concretely it addresses the risk assessment and the proportionality of the measure.

Gather evidence of family, work, residence and length of stay. These documents are the basis for arguments under Article 8 ECHR.

The deadline ends soon, you should act immediately now.

If the appeal deadline ends in the next few days, clarifying the next steps takes priority. An appeal filed in time protects your rights even if the reasoning is added later. What matters most is that the deadline is not missed, because otherwise the decision becomes final.

At the same time, clarify whether the appeal has suspensive effect. Whether you may remain in Austria until the decision depends on this.

The usual deadline may have expired, a careful review is important.

If more than the usual deadline has passed since service, the decision may already be final. That does not necessarily mean nothing can be done. In certain cases an application for reinstatement is possible where the deadline was missed without fault of your own.

Independently of this, the option remains to apply for the entry ban to be lifted or shortened once circumstances have changed. A careful review of the individual case provides clarity.

The start of the deadline is open, the service date should be clarified first.

As long as it is unclear when and whether the decision was validly served, the deadline cannot be calculated reliably. Defective service can mean that the deadline has not yet started to run. Check the address to which service was made and whether you actually received the decision.

Keep all envelopes, delivery receipts and notifications. These records are decisive for establishing the start of the deadline in a comprehensible way.

The appeal deadline is the decisive moment

The most important deadline after an entry ban is the appeal deadline. It begins with service of the decision and as a rule is four weeks. In certain accelerated proceedings it can be considerably shorter. What is decisive is always the date on which the decision was validly served, not the day on which you read it.

If the deadline is missed, the decision becomes final and the entry ban becomes enforceable. A later challenge is then possible only in narrow exceptional cases. Alongside the appeal deadline, the question of suspensive effect plays a role. It decides whether you may remain in Austria until the court decides. The entry on suspensive effect explains more.

The first steps after service

Read the decision in full first and pay attention to the reasoning. The authority bases the entry ban on a risk assessment and sets its duration. It is precisely this reasoning that a later appeal addresses. Note which circumstances the authority relied on and which points are incomplete or incorrect from your perspective.

In parallel, gather all evidence of your ties in Austria. This includes registration records, an employment contract, evidence relating to family members and proof of length of stay. These documents form the basis for the balancing exercise under Article 8 ECHR and thus for arguing against a disproportionate entry ban.

Important with a short deadline: Do not miss the appeal deadline because documents are still missing. An appeal filed in time can be supplemented in its reasoning. A missed deadline, by contrast, can only be repaired in narrow exceptional cases. When in doubt act quickly and arrange an initial consultation (72 euros).

How long do I have to challenge an entry ban? +

As a rule the appeal deadline is four weeks from service of the decision. In accelerated proceedings it can be shorter. What is decisive is the date of valid service. If the deadline is missed, the decision becomes final and the entry ban becomes enforceable.

What happens if I miss the deadline? +

Once the deadline expires the decision becomes final. An appeal is then no longer possible. In narrow exceptional cases an application for reinstatement is available where the deadline was missed without fault of your own. Independently of this, a later application to lift or shorten the ban remains possible.

May I stay in Austria during the proceedings? +

That depends on whether the appeal has suspensive effect. Where it applies, the measure may not be enforced until a decision is taken. Suspensive effect is not automatically present in every case and can be withdrawn under certain conditions. This question should be examined together with the appeal.
